Hip Quick Legal Tip | Bail Reviews in The State of Maryland

Hi everybody, this is Jason Fox from the Law Offices of James Crawford Law, giving you a Hip Quick Legal Tip. Alright, so today I want to talk to you about bail reviews. This is an often overlooked part of the legal process. A lot of people think that they can handle this by themselves. It’s a big mistake. You need an experienced attorney during this stage of the process because it can have significant impacts down the road, mainly having to do with whether or not you are waiting in jail until your pending trial date, which could be a month, six months, a year. So this could be your one shot to get out of jail pending trial which is why you want an experienced attorney there with you.

Now, what happens at a bail review? At a bail review, you’re going to be most likely on a video prompter, and during that time the state’s attorney may or may not be there, but there will definitely be a judge. What is he factoring in? He’s factoring a few things. Number one: are you going to fail to appear in court? So if you have any prior failure to appears or if there’s anything else out there that might scare the judge into thinking that you’re not going to appear in court, you need an attorney there to explain those reasons and to give reasons why, for sure, that you are going to show up for court. The other major thing is whether or not you’re a danger to the community. Now, this can be through the actual nature of the offense itself. It can be a victim crime or whatever it is. They can also look at your past history.

Look, this is why you hire with an attorney that’s going to meet with you and your family prior to your bail review. We’re going to get the full story, that way we can tell everything that we need to say in court. This is not a time to try your case, but having an attorney there, we have a little leeway to sneak in some of the facts of the case and knock down some of the potential problems the state has with this. The judge will normally listen to us. So look, before you go at this bail review alone, hire an experienced attorney. We have handled them all across the State of Maryland. Give us a call and we’ll be able to help you out. Thanks.
